Rental Agreement & Terms of Service

This Rental Agreement is entered into by and between Carolina Party Essentials (“Company”) and the individual or entity renting the equipment (“Renter”). By signing this Agreement, or by accepting it electronically at checkout, the Renter agrees to the terms and conditions set forth below.

1. Equipment Rented

The equipment to be rented (“Equipment”) is listed on the accompanying invoice or delivery confirmation document, which is hereby incorporated into this Agreement.

2. Rental Period

The rental period begins on the date and time the Equipment is delivered or picked up by the Renter and ends when the Equipment is returned to Carolina Party Essentials.

  • If the Equipment is not returned by the agreed-upon time, the Renter will be charged a late return fee of $20 per item, per day, until the Equipment is returned.
  • If the Equipment is not returned within three (3) days of the agreed-upon return date, the Renter will be charged the full replacement cost of the Equipment as set out in Schedule B.

3. Liability Waiver and Assumption of Risk

  • The Renter assumes all risks and responsibilities associated with the use, operation, and possession of the Equipment.
  • The Renter assumes full responsibility for the safe and proper setup, operation, and supervision of the Equipment. Carolina Party Essentials is not responsible for injury, damage, or failure resulting from improper use or failure to follow any provided instructions.
  • Carolina Party Essentials, its owners, employees, and agents shall not be held liable for any injuries, damages, or losses arising from the use or misuse of the Equipment, to the fullest extent permitted by law.
  • In no event shall Carolina Party Essentials' liability exceed the total rental fees paid by the Renter. Carolina Party Essentials shall not be liable for incidental, indirect, or consequential damages of any kind.

4. Indemnification

The Renter agrees to indemnify, defend, and hold harmless Carolina Party Essentials, its employees, and agents from any claims, damages, losses, or legal expenses resulting from the use of the rented Equipment, including but not limited to claims of injury or property damage.

5. Equipment Inspection and Acknowledgment

  • The Renter acknowledges that all Equipment was inspected and deemed to be in good working order at the time of receipt.
  • Any damages or defects must be reported to Carolina Party Essentials immediately upon receipt of the Equipment.
  • Carolina Party Essentials may photograph or video the Equipment at the time of pickup or delivery and again upon return, to document its condition. These records may be used to support any charge assessed under Section 7.

6. Prohibited Uses

  • The Equipment shall not be used in any manner inconsistent with its intended purpose, in unlawful activities, or under unsafe conditions. Unsafe conditions include, but are not limited to, extreme weather, inadequate supervision, or unauthorized modifications to the Equipment.
  • If the Equipment is used in the presence of minors, the Renter agrees to ensure that all minors are supervised by a responsible adult at all times. Failure to provide adequate supervision may result in liability for damages or injuries.
  • The Renter may not relocate, sublease, or loan the Equipment to any third party, or to any address other than the originally agreed-upon event location, without prior written consent from Carolina Party Essentials.
  • Violations of this provision will result in the immediate termination of this Agreement, and the Renter will be liable for any resulting damages.

7. Equipment Damage, Loss, Cleaning, and Replacement Costs

  • The Renter agrees to return all Equipment in the same condition as received, including being clean and free of debris.
  • If the Equipment is returned dirty, or with food residue, sugar, grease, or other debris, the Renter will be charged the applicable cleaning fee set out in Schedule A.
  • In the event of damage, loss, or theft of the Equipment, the Renter will be charged the documented cost of repair, or the replacement cost set out in Schedule B, whichever is lower. Where an item is not listed in Schedule B, the charge will be the documented cost of replacing the item with one of equivalent make and condition, supported by a receipt or supplier invoice.
  • Charges assessed under this Section will be processed within five (5) business days of the Equipment's return, or within five (5) business days of the date the Equipment became overdue. An itemized invoice, together with any supporting photographs or receipts, will be provided to the Renter at the time of the charge.
  • Schedule A and Schedule B are incorporated into and form part of this Agreement.

8. Credit Card on File — Storage and Charge Authorization

This Section describes how Carolina Party Essentials stores the Renter's payment card and when that card may be charged. Please read it carefully.

  • Storage. Carolina Party Essentials uses Stripe, Inc. as its payment processor. When the Renter pays for a rental, the Renter's payment card is stored securely by Stripe on the Company's behalf for use in accordance with this Agreement. Carolina Party Essentials does not receive or retain the Renter's full card number.
  • Authorization. The Renter authorizes Carolina Party Essentials to charge the card on file, without further authorization at the time of the charge, for any amount properly due under this Agreement. This includes late return fees, cleaning fees, repair costs, replacement costs, and any unpaid rental balance.
  • How amounts are determined. Charges are calculated using the published fee schedule in Schedule A and the replacement costs in Schedule B, or, where an item is not listed, the documented cost supported by a receipt or supplier invoice. Carolina Party Essentials will not charge an amount that is not supported by this Agreement.
  • Notice. The Renter will receive an itemized invoice describing each charge, the item concerned, and the basis for the amount. Charges are made no earlier than the date the invoice is issued.
  • Duration. The card on file will be retained for the term of this Agreement as set out in Section 12, and may be used for any rental made by the Renter during that term.
  • Revocation. The Renter may revoke this authorization at any time by written notice to info@carolinapartyessentials.com. Revocation takes effect once Carolina Party Essentials has had a reasonable opportunity to act on it. Revocation does not release the Renter from liability for amounts already due, and Carolina Party Essentials may decline to release Equipment to a Renter with no valid card on file.
  • Authority. The Renter represents that they are the authorized cardholder, or are authorized by the cardholder to present the card and to agree to these terms.

9. Payment Terms

  • Payment for the rental fee must be made in full prior to the delivery or pickup of the Equipment.
  • Accepted payment methods include credit card, debit card, and other methods agreed upon in writing by Carolina Party Essentials.
  • Applicable taxes and additional fees, if any, will be disclosed at the time of booking and included in the final invoice.
  • Cancellations made at least seven (7) days before the pickup date are eligible for a full refund. Cancellations made after that time are non-refundable.

10. Force Majeure

Carolina Party Essentials is not responsible for delays, cancellations, or damages caused by events beyond its control, including acts of God, weather conditions, or government restrictions.

11. Governing Law, Venue, and Legal Fees

  • This Agreement shall be governed by the laws of the State of North Carolina.
  • Any disputes arising from this Agreement will be resolved in the state or federal courts located in Cabarrus County, North Carolina.
  • In the event of a dispute or collection action, the prevailing party shall be entitled to recover reasonable attorney fees, court costs, and collection expenses.

12. Duration of Agreement

  • This Agreement shall remain in effect for a period of 365 days from the date of signing or electronic acceptance, and shall apply to any and all Equipment rentals by the same Renter during that period.
  • The Renter acknowledges that this Agreement will be kept on file and will govern all rentals within the 365-day period unless otherwise terminated or amended in writing.

13. Signature, Electronic Acceptance, and Consent

  • Electronic acceptance. The Renter may accept this Agreement by checking the acceptance box presented at checkout. Electronic acceptance has the same force and effect as a handwritten signature, and Carolina Party Essentials will retain a record of the date, time, and transaction associated with that acceptance.
  • Authority. If the Renter is an entity or organization, the individual signing or accepting this Agreement represents and warrants that they have full authority to bind the entity. The entity, and not the individual signing, shall be deemed the Renter and shall be fully responsible for all obligations under this Agreement.
  • Marketing. The Renter grants Carolina Party Essentials permission to use photographs or videos taken during the rental period for marketing or promotional purposes, unless the Renter opts out by written notice to info@carolinapartyessentials.com.

14. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Schedule A — Fee Schedule

The following fees apply to all rentals and are charged to the card on file in accordance with Sections 7 and 8.

Cleaning fees are assessed per item, not per order. Equipment returned in a condition requiring more than routine wiping down — including sugar residue in cotton candy equipment, grease in hot dog rollers, or oil residue in popcorn kettles — is subject to the deep cleaning fee.

Schedule B — Replacement Cost Schedule

Replacement costs reflect the current cost to Carolina Party Essentials of replacing the item with one of equivalent make and condition. Where actual replacement cost at the time of loss differs, the documented actual cost applies, supported by a receipt or supplier invoice.

This schedule is reviewed periodically and may be updated to reflect current market cost. The schedule in effect on the date of the rental applies to that rental.

Consumable items — including cotton candy floss sugar, popcorn portion packs, and popcorn bags — are sold rather than rented and are not subject to return, cleaning, or replacement charges.
